Citizenship by Descent
Citizenship by Descent
In terms of the South African Citizenship Act, which has been amended by the Amendment Act of 2010, a person shall only be a South African citizen by descent if such person has been adopted in accordance with the Childrens Act by a South African citizen and such child’s birth has been registered.
Legal Requirements
The acquisition of citizenship by descent is strictly governed by South African legislation. It is essential to ensure that all documentation—specifically relating to adoption orders and birth registration—meets the criteria set out by the Department of Home Affairs.
- Valid adoption order in accordance with the Children's Act.
- Proof of citizenship of the adoptive parent.
- Registered birth certificate of the child.
